1. General Conditions
These Terms and Conditions (“Terms”) apply to all services provided by Opal SA Construction Pty Ltd (“the Company”).
By engaging our services, the client (“you” or “the customer”) agrees to these Terms in full. Variations must be agreed to in writing.
All works are carried out according to Australian Standards and Workplace Health & Safety regulations.
2. Quotes & Pricing
All quotes are valid for thirty (30) days from the issue date unless stated otherwise.
Any changes to the scope of work, materials, or site conditions may result in additional costs.
Quoted prices exclude rock excavation, unsuitable material removal, and reinstatement unless specified.
Additional labour or machinery required due to access issues or client-caused delays will be charged accordingly.
3. Payment Terms
For quotes under $20,000 → 50% deposit is required before commencement.
For quotes over $20,000 → 35% deposit is required before commencement.
The remaining balance is payable within 7 days of completion unless otherwise agreed in writing.
Late payments incur interest at the 90-day RBA rate +10% per annum, plus a $75 monthly late fee.
All materials, products, and work remain the property of Opal SA Construction Pty Ltd until payment is received in full.
Recovery costs (including debt collection or legal fees) will be charged to the client.
4. Delays & Site Conditions
Completion times depend on reasonable site access, weather, and availability of materials.
The Company is not responsible for delays caused by other trades, poor access, or weather.
Delays exceeding 15 minutes due to site inaccessibility or other trades may incur a charge of $75 per hour per worker (calculated in 15-minute blocks).
5. Variations
Any work not specified in the original quote will be considered a variation and charged accordingly.
Verbal variations may be accepted but will still be charged as per time and materials used.
Additional costs due to incorrect information or rework will be charged at $75 per hour per worker (plus GST).
6. Defects & Warranties
All work will be carried out with due care and skill according to industry standards.
Concrete and decorative finishes are subject to natural variation in colour and texture.
Minor cracking and surface imperfections are natural and not considered defects.
Any defects must be reported in writing within 48 hours of identification.
Rectification will occur only after full payment has been made.
The Company will not be responsible for defects caused by other trades, incorrect plans, or client-directed changes.
7. Cancellation
A minimum of 24 hours written notice is required for job cancellation.
Less than 24 hours’ notice will incur a $100 cancellation fee (including GST).
Less than 2 hours’ notice will incur full costs including subcontractors, machinery, and material expenses.
All materials purchased specifically for the job will be charged in full if the job is cancelled.
8. Safety Obligations
Opal SA Construction Pty Ltd complies with South Australia’s Workplace Health and Safety laws.
Clients must provide safe and unrestricted site access.
Unsafe or obstructed worksites may result in project suspension or additional costs until hazards are resolved.
9. Liability & Insurance
Opal SA Construction Pty Ltd maintains appropriate public liability and worker’s compensation insurance.
The Company is not liable for damage to underground services unless such locations are clearly marked or disclosed prior to work commencing.
Clients must ensure plans and details provided are current and accurate.
10. Governing Law
These Terms and Conditions are governed by the laws of South Australia.
Any disputes shall be resolved through negotiation and, if necessary, by an appropriate court within South Australia.
